General Provisions
These terms and conditions apply exclusively between the company Verona Reptiles Sas di Filippo Tosano & C., with registered office in Via Masaccio, 7 – 37053 Cerea (VR), VAT no. IT04683130233, hereinafter referred to as “Herp Italia”, and any individual making online purchases on the website www.herp-italia.com, hereinafter referred to as the “CLIENT”. These conditions may be subject to modifications, and the date of their publication on the website shall be considered as the effective date of entry into force. These conditions govern purchases made on the website www.herp-italia.com, in accordance with the provisions of Part III, Title III, Chapter I of the Italian Consumer Code (Legislative Decree no. 206/2005), as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 concerning e-commerce.
ARTICLE 1 – Subject of the Contract
Under these general terms and conditions of sale, Herp Italia sells and the CLIENT purchases remotely the tangible movable goods indicated and offered for sale on the website www.herp-italia.com. The contract is concluded exclusively via the Internet, by the CLIENT accessing the website www.herp-italia.com and placing a purchase order through the procedure provided on the site. The CLIENT undertakes to read these general terms and conditions of sale, particularly the pre-contractual information provided by Herp Italia, before confirming the order, and to accept them.
ARTICLE 2 – Pre-contractual Information for the Consumer (Art. 49 of Legislative Decree 206/2005)
Before concluding the purchase contract, the CLIENT shall review the characteristics of the goods as described in the individual product sheets at the time of selection. Before completing the purchase and validating the order with “payment obligation,” the CLIENT shall be informed of:
the total price of the goods, including taxes, with details of shipping and any other costs;
payment methods;
the timeframe within which Herp Italia undertakes to ship the goods;
the conditions, terms, and procedures for exercising the right of withdrawal (see Article 6 below), as well as the standard withdrawal form set out in Annex I, Part B of Legislative Decree 21/2014;
the fact that the CLIENT must bear the cost of returning the goods in the event of withdrawal;
the existence of a legal guarantee of conformity for purchased goods;
post-sale assistance conditions and commercial warranties provided by Herp Italia.

ARTICLE 3 – Conclusion and Effectiveness of the Contract
The sales contract is deemed concluded when Herp Italia sends the CLIENT a confirmation email of the order. This email contains the CLIENT’s details, order number, total price, shipping costs, delivery address, and a link to print and store a copy of these terms and conditions. The CLIENT undertakes to verify the accuracy of the personal data contained therein and promptly notify Herp Italia of any corrections. Herp Italia commits to describing and presenting the products on the site as accurately as possible. However, minor errors, inaccuracies, or slight differences between the website and the actual product may occur. Product photos on www.herp-italia.com are for illustrative purposes only and are not contractual elements. Herp Italia undertakes to ship the goods within 24 working hours from receipt of payment.
ARTICLE 4 – Product Availability
Product availability refers to the actual availability at the time the CLIENT places the order. Even after Herp Italia has sent the order confirmation email, cases of total or partial unavailability may occur due to updating errors. In such cases, the CLIENT will be promptly contacted by email or telephone by Herp Italia’s Orders Department and informed of the expected restocking and delivery times. If, due to unavailability, the CLIENT requests the cancellation of the order, the contract shall be terminated and Herp Italia will refund the amount paid within 14 days from the date it becomes aware of the CLIENT’s decision to terminate.
ARTICLE 5 – Payment Methods
Payments may be made exclusively by the means indicated on the website www.herp-italia.com: credit card, bank transfer, Postepay recharge, or PayPal. Payment communications and related data provided by the CLIENT are transmitted via secure lines inaccessible to Herp Italia staff. Credit card payments are protected by VBV (Verified by VISA) and SCM (Security Code Mastercard) certifications.
ARTICLE 6 – Prices
All sales prices shown on www.herp-italia.com are expressed in Euros and include VAT, unless otherwise specified. Shipping costs are not included in the purchase price but are displayed and calculated before payment, based on parcel volume/weight and destination postal code. The CLIENT accepts Herp Italia’s right to modify prices at any time; however, goods will be invoiced at the rates in effect on the website at the time the order is created, as confirmed in the order email. In the event of an error—computer, manual, technical, or otherwise—that results in a substantial, unintentional, and clearly incorrect price, the order shall be deemed invalid and cancelled, and any amount paid shall be refunded within 14 days of cancellation.
ARTICLE 7 – Right of Withdrawal
In accordance with applicable law, the CLIENT has the right to withdraw from the purchase without penalty and without specifying a reason within 30 days from receipt of the products. To exercise this right, the CLIENT must send an explicit notice of withdrawal to Herp Italia by email at [email protected], containing the following:

The CLIENT must return the goods within 30 days from the date they informed Herp Italia of their decision to withdraw, to the following address:

Return shipping costs are the responsibility of the CLIENT.
Returned goods must be intact, in the original packaging, complete in all parts (including packaging, documentation, and accessories), and accompanied by the related tax documentation. Herp Italia will refund the amount paid within 14 days, after verifying that the above conditions are met.
Pursuant to Art. 56(3) of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, Herp Italia may withhold the refund until receipt of the goods or proof of their return. Refunds will be made either via a credit on the CLIENT’s account or through the same payment method used for the purchase. For bank transfer payments, the CLIENT must provide IBAN, SWIFT, and BIC details. For Postepay recharges, the CLIENT must provide either bank coordinates or a PayPal address. Otherwise, a credit voucher will be issued. For purchases made using a gift card or loyalty coupon, the refund will be issued as a promotional code valid for two years.
ARTICLE 8 – Legal Guarantee of Conformity
In case of receipt of defective or non-conforming products, the CLIENT has the right to have the product’s conformity restored free of charge through repair or replacement. The CLIENT must report the defect to Herp Italia within two months of discovery and within two years of delivery (or within one year for business purchases with VAT number). ARTICLE 10 – Liability
Herp Italia shall not be liable for any disruptions due to force majeure or unforeseeable events, including internet malfunctions, that prevent timely order execution.
ARTICLE 11 – Website Access
The CLIENT has the right to access the website for consultation and purchase purposes only. Any other use, particularly commercial use, is prohibited. All elements of this website, whether visual or audio, and the related technology remain the property of Herp Italia and are protected by intellectual property law.
ARTICLE 12 – Cookies
The website www.herp-italia.com uses cookies—electronic files that record information on the CLIENT’s browsing activity (pages viewed, date and time, etc.)—to provide a personalized service. The CLIENT may disable cookies via their browser settings; however, doing so will prevent online purchasing.
ARTICLE 13 – Entire Agreement
These General Terms and Conditions of Sale comprise the entirety of the clauses contained herein. If one or more clauses are deemed invalid or unenforceable by law or court decision, the remaining provisions shall remain in full force and effect.
ARTICLE 14 – Applicable Law and Jurisdiction
These General Terms and Conditions of Sale are governed by Italian law. Any dispute not amicably resolved shall fall under the exclusive jurisdiction of the court of the CLIENT’s place of residence or domicile, provided it is within Italian territory. In any case, the CLIENT may voluntarily resort to the mediation procedures provided for by Legislative Decree 28/2010 for resolving disputes arising from the interpretation or execution of these terms and conditions, via the following website:
